The following General Terms and Conditions (GTC) of<\/p>\n\n

(hereinafter “KUPF Services GmbH”) apply to all end customers of the platforms kupfticket.com and kulturspenden.at (hereinafter “Customers”). Insofar as individual provisions expressly concern consumers, they apply to Customers who are consumers within the meaning of the Austrian Consumer Protection Act (KSchG).<\/p>\n\n

They comprise the following sections:<\/p>\n\n

1. Scope and Incorporation<\/h2>\n\n

These GTC apply to the purchase of tickets and vouchers, to donations and to the use of the user account via the platforms kupfticket.com and kulturspenden.at. They do not apply to on-site sales (e.g. box office, catering at the venue); such sales are governed exclusively by the terms of the respective organisers.<\/p>\n\n

For purchases and donations, the version of these GTC valid at the time of the order or donation applies. For the user account, the version accepted upon registration applies; changes are governed by Section 11.<\/p>\n\n

By ticking the checkbox “I accept the General Terms and Conditions of KUPF Services GmbH and of the respective organisers or donation recipients” before submitting the order or donation, Customers agree to these GTC and to the terms and conditions of the respective organisers or donation recipients linked in the checkout. These GTC can be accessed at any time at kupfservices.com\/en\/terms-and-conditions\/general-terms-and-conditions-for-end-users<\/a> and can be saved and printed.<\/p>\n\n

2. Role of KUPF Services GmbH<\/h2>\n\n

KUPF Services GmbH operates the platforms kupfticket.com and kulturspenden.at as an intermediary. It is itself neither an organiser nor a donation recipient nor an issuer of vouchers.<\/p>\n\n

Contracts for tickets and vouchers are concluded exclusively between Customers and the respective organiser; donations are made to the respective donation recipient. KUPF Services GmbH provides the technical processing to Customers (in particular the ordering process, payment processing, delivery of tickets and vouchers, donation confirmations) as well as the operation of the user account.<\/p>\n\n

The Customers’ contracting party is the shop operator identified in the respective shop as the seller or donation recipient. In these GTC, the shop operator is referred to as the “organiser” \u2013 even where it does not stage the event itself but offers tickets for events of third parties.<\/p>\n\n

The respective organisers and donation recipients are solely responsible for the staging of events, the redemption of vouchers, the use of donations and for refunds arising from these contractual relationships. Their contact details are provided in the respective shop and on the ticket or voucher.<\/p>\n\n

3. Purchase of Tickets<\/h2>\n\n

By clicking the button “Order with obligation to pay”, Customers submit a binding offer to purchase the tickets in the shopping cart. The contract with the organiser is concluded upon the order confirmation that Customers receive by email. The order confirmation contains the order details and these GTC; Customers can save and print it.<\/p>\n\n

Tickets are delivered by email and made available for download. They can be printed or displayed on a smartphone or other device. Customers with a user account can additionally access their tickets in the account at any time.<\/p>\n\n

Tickets only become valid upon payment in full. Each ticket contains a unique code (QR code and alphanumeric code) that is valid only once: upon first admission the ticket loses its validity, and further tickets with the same code will be denied admission, unless the organisers provide for a different arrangement (for example for multiple admission). Customers should therefore protect their tickets from access by third parties and should not copy or forward them. If a ticket is used because its code has come into the hands of third parties, there is no entitlement to a replacement.<\/p>\n\n

Organisers may personalise tickets for security reasons. Whether and under what conditions tickets may be transferred to other persons is governed by the terms of the respective organisers. By using the ticket, Customers accept the house rules of the venue.<\/p>\n\n

Cancellation by the platform.<\/strong> KUPF Services GmbH is entitled \u2013 in coordination with and in the name of the respective organiser \u2013 to cancel orders up to the beginning of the event if<\/p>\n\n

a) conditions of sale displayed in the shop are violated or circumvented, in particular limits on the number of tickets per person or per order or a personalisation requirement,<\/p>\n\n

b) orders are placed in an automated manner (for example by bots), or several accounts or email addresses of the same person are used in order to circumvent ticket limits or other conditions of sale,<\/p>\n\n

c) tickets are resold commercially or above the purchase price contrary to the terms of the organiser, or<\/p>\n\n

d) there are reasonable indications of fraudulent use of the means of payment.<\/p>\n\n

Customers will be informed of a cancellation by email; the cancelled tickets lose their validity and the price paid will be refunded to the means of payment used for the purchase. Section 7 (suspension of the user account) remains unaffected.<\/p>\n\n

4. Cancellation, Postponement and Refunds<\/h2>\n\n

If an event is cancelled, postponed or materially changed, all claims of Customers (in particular for a refund of the ticket price) lie exclusively against the organiser. KUPF Services GmbH will, where possible, inform Customers by email as soon as the organisers notify it of a cancellation or postponement.<\/p>\n\n

Refunds may be initiated by the organiser via the platform; in this case, repayment is made to the means of payment used for the purchase. Customers may also contact the organiser directly for refunds. KUPF Services GmbH itself does not owe refunds arising from the ticket or voucher contract; its statutory responsibility for its own errors in processing (for example an erroneous double charge) remains unaffected.<\/p>\n\n

Minor and reasonable changes to the programme, the line-up or the schedule initiated by the organiser or the artists do not constitute a cancellation or material change and do not give rise to a refund claim. Customers’ own expenses in connection with attending the event (e.g. travel, accommodation) will not be reimbursed by KUPF Services GmbH in the event of cancellation, postponement or change; whether and to what extent the organiser reimburses such expenses is governed by the organiser’s terms and the statutory provisions.<\/p>\n\n

5. Vouchers<\/h2>\n\n

Value vouchers of individual organisers can be purchased via the platform. The issuer of the voucher and the Customers’ contracting party is the respective organiser. Section 3 applies mutatis mutandis to the conclusion of the contract and delivery.<\/p>\n\n

Vouchers are denominated in euros, are valid indefinitely and can be redeemed exclusively in the shop of the issuing organiser. Redemption in partial amounts is possible; any remaining credit is retained. A cash payout of the voucher value or of remaining credit is not possible.<\/p>\n\n

Consumers have a right of withdrawal of 14 days when purchasing a voucher (see Section 10). The right of withdrawal expires to the extent that the voucher has already been redeemed within this period.<\/p>\n\n

6. Donations<\/h2>\n\n

Via kulturspenden.at, Customers can make donations to the donation recipients represented there. KUPF Services GmbH forwards the donation to the donation recipient and sends a donation confirmation by email. The donation recipient is solely responsible for the use of the donation.<\/p>\n\n

Donations are voluntary, gratuitous contributions and cannot be reversed once the payment process has been completed. There is no right of withdrawal for donations under the Austrian Distance and Off-Premises Transactions Act (FAGG). In the event of accidental incorrect payments (for example an obviously incorrect amount), Customers may contact the donation recipient or KUPF Services GmbH.<\/p>\n\n

Tax Deductibility<\/h3>\n\n

If the donation recipient is recognised as a donation-beneficiary institution within the meaning of Section 4a of the Austrian Income Tax Act (EStG) and the corresponding option is activated in the shop, the donation can be deducted for tax purposes. For this purpose, the donation recipient transmits \u2013 where applicable on its behalf via the platform \u2013 the donation data pursuant to Section 18(8) EStG to the tax authorities.<\/p>\n\n

This requires that Customers state their first name, surname and date of birth when donating exactly as they are recorded in the Austrian Central Register of Residents. Providing this data is voluntary; Customers may expressly prohibit the transmission at any time or refrain from providing the data, in which case the donation will not be taken into account for tax purposes. Customers themselves are responsible for the accuracy of the data provided.<\/p>\n\n

KUPF Services GmbH is not itself a donation recipient. Whether the requirements for the donation-beneficiary status are met and whether the transmission to the tax authorities is carried out completely and on time is the responsibility of the respective donation recipient.<\/p>\n\n

Recurring Donations<\/h3>\n\n

Customers can set up a recurring donation with a freely selectable amount and interval. The amount is debited at the selected interval from the stored means of payment; a donation confirmation is sent for each debit.<\/p>\n\n

A recurring donation can be ended or changed in amount by Customers at any time without giving reasons \u2013 in the user account or by email to office@kupfticket.com. The termination applies to all debits falling due after receipt of the declaration; donations already debited will not be refunded. The donation recipient and KUPF Services GmbH may likewise end a recurring donation at any time, for example if the donation recipient’s shop is closed; Customers will be informed by email. If a debit fails, it may be attempted again in the following days; if it remains unsuccessful, the recurring donation will be ended and the Customers will be informed by email. Amounts that could not be debited will not be collected retrospectively.<\/p>\n\n

7. User Account<\/h2>\n\n

Customers can create a free user account on the platforms. The account is not required for purchases and donations. It allows Customers in particular to view tickets and their purchase history, to store data for a faster checkout, to manage donation data and donation confirmations and to manage recurring donations.<\/p>\n\n

A user account can be used both for end-customer functions and as a personal access to one or more shops. Insofar as users access functions of a shop, they act in the name of the respective shop operator; such use is governed exclusively by the separate GTC for shop operators, which are accepted for each shop by the shop operator or by a person authorised to do so. Use of the user account as an end customer and use in the name of a shop operator constitute independent contractual relationships: deletion of the user account leaves the contractual relationship between the shop operator and KUPF Services GmbH unaffected; conversely, the termination or suspension of a shop affects neither the personal user account nor privately purchased tickets and vouchers.<\/p>\n\n

Natural persons aged 14 or over are entitled to register. Customers must provide correct and complete information upon registration and keep it up to date. Only one account per person is permitted.<\/p>\n\n

Customers must treat their access data confidentially and protect it from access by third parties. If there is a suspicion that third parties have gained access to the account, KUPF Services GmbH must be informed immediately; the password should be changed immediately in this case.<\/p>\n\n

KUPF Services GmbH may temporarily suspend an account if there are reasonable indications that it is being misused \u2013 in particular in the cases mentioned in Section 3 (cancellation by the platform), in the event of unauthorised access by third parties or in the event of a violation of these GTC \u2013 or if an official or court order so requires. Customers will be informed of the suspension and its reason by email and will be given the opportunity to comment; the suspension will be lifted as soon as the reason has ceased to exist. Tickets and vouchers already purchased remain unaffected by a suspension and remain available by email.<\/p>\n\n

Customers can delete their account at any time without giving reasons \u2013 via the deletion function in the account or by email to office@kupfticket.com. KUPF Services GmbH may terminate the contractual relationship concerning the account with four weeks’ notice by email, and with immediate effect in the event of significant violations of these GTC or of misuse. Tickets and vouchers already purchased remain unaffected by a deletion of the account and remain available by email; ongoing recurring donations will be ended upon deletion of the account unless Customers specify otherwise. Statutory retention obligations remain unaffected.<\/p>\n\n

KUPF Services GmbH endeavours to ensure the constant availability of the account but cannot guarantee it; maintenance work and technical disruptions may lead to temporary restrictions.<\/p>\n\n

The processing of personal data in connection with the account is described in the privacy policy<\/a>.<\/p>\n\n

8. Prices and Payment<\/h2>\n\n

All prices are in euros and include any applicable statutory value added tax. Tickets and vouchers on kupfticket.com have an all-in price: fees for payment processing are already included, and no additional fees are charged to Customers.<\/p>\n\n

Payment processing is handled by Stripe Payments Europe, Ltd., domiciled in Ireland. The payment methods displayed in the checkout are available.<\/p>\n\n

9. Warranty and Liability<\/h2>\n\n

The warranty is governed by the statutory provisions.<\/p>\n\n

KUPF Services GmbH is liable for damage arising from its own services (Section 2) in accordance with the statutory provisions. Vis-\u00e0-vis consumers, liability for damage caused by slight negligence is excluded; this does not apply to personal injury or to the breach of material contractual obligations. KUPF Services GmbH is not liable for the services of the organisers and donation recipients \u2013 in particular for the staging of events, the redemption of vouchers, the use of donations and refunds.<\/p>\n\n

10. Right of Withdrawal for Consumers<\/h2>\n\n

Tickets:<\/strong> There is no right of withdrawal for the purchase of tickets pursuant to Section 18(1)(10) of the Austrian Distance and Off-Premises Transactions Act (FAGG), as these are services related to leisure activities for which a specific date or period of performance is contractually stipulated.<\/p>\n\n

Donations:<\/strong> There is no right of withdrawal for donations (see Section 6).<\/p>\n\n

Vouchers:<\/strong> Consumers have the following right of withdrawal when purchasing vouchers.<\/p>\n\n

Instructions on Withdrawal<\/h3>\n\n

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day of the conclusion of the contract.<\/p>\n

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by an unequivocal statement (e.g. by email or by post). When purchasing a voucher, address the statement to the issuing organiser; you may also address it to KUPF Services GmbH (Untere Donaul\u00e4nde 10\/1, 4020 Linz, Austria, office@kupfticket.com), which will forward it to the organiser without delay. You may use the online function \u201cWithdraw from contract\u201d<\/a> or the model withdrawal form also available there; their use is not obligatory. If you use the online function, we will send you an acknowledgement of receipt by email without undue delay, containing the content of your notice and the date and time of its receipt. To meet the withdrawal deadline, it is sufficient for you to send your statement before the withdrawal period has expired.<\/p>\n

If you withdraw from the contract, all payments we have received from you will be reimbursed without undue delay and no later than 14 days from the day on which the statement of your withdrawal was received. The reimbursement will be made using the same means of payment that you used for the payment, unless expressly agreed otherwise; you will not be charged any fees for the reimbursement. If a voucher has been redeemed in whole or in part within the withdrawal period, the right of withdrawal expires to the extent of the redemption.<\/p>\n\n

11. Changes to these GTC<\/h2>\n\n

For purchases and donations, the version valid at the time of the order or donation always applies; changes do not affect purchases already concluded and donations already made.<\/p>\n\n

For the user account and ongoing recurring donations, KUPF Services GmbH may amend these GTC, in particular to adapt them to changed legal requirements, to new or changed functions of the platforms or to technical developments. Planned changes will be communicated to Customers by email at least one month before they take effect; the material changes will be highlighted and the new version will be transmitted or linked.<\/p>\n\n

The amended version only becomes effective if Customers actively consent to it \u2013 in the user account or via a confirmation link sent by email. If Customers do not consent, they may delete their account or end their recurring donation at any time (Sections 6 and 7). KUPF Services GmbH may make continued use of the account after expiry of the notice period conditional on consent; tickets and vouchers already purchased remain unaffected.<\/p>\n\n

12. Final Provisions<\/h2>\n

The language of the contract is German. These GTC are also available in English; in case of discrepancies, the German version prevails.<\/p>\n

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers habitually resident in another state, the mandatory consumer protection provisions of that state remain unaffected.<\/p>\n\n

KUPF Services GmbH is not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board. Complaints may be addressed to office@kupfticket.com.<\/p>\n\n

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.<\/p>\n","protected":false},"excerpt":{"rendered":"
