The following General Terms and Conditions (GTC) of<\/p>\n\n
KUPF Services GmbH<\/strong> (hereinafter “KUPF Services GmbH”) apply to all operators of shops on the platforms kupfticket.com, kulturspenden.at and kupfservices.com (hereinafter “Users”).<\/p>\n\n Version date: <\/strong>13 August 2026<\/p>\n\n They comprise the following sections:<\/p>\n\n 1. Subject Matter and Availability<\/strong><\/p>\n\n KUPF Services GmbH provides its platform kupfticket.com to Users for the promotion of cultural events and the sale of admission tickets for such events. KUPF Services GmbH further provides its platform kulturspenden.at to Users for the solicitation of donations. <\/p>\n\n KUPF Services GmbH endeavours to ensure trouble-free operation of the platforms but assumes no warranty or liability for outages caused by hardware damage or software problems within its own sphere of influence or at third parties (e.g. internet providers, hosting providers), except in cases of intent or gross negligence.<\/p>\n\n 2. Role of Users vis-\u00e0-vis End Customers <\/strong><\/p>\n\n Users themselves act as sellers of the admission tickets vis-\u00e0-vis end customers; KUPF Services GmbH therefore does not enter into any direct business relationship with end customers, provides no warranty to them and provides no support for them. Likewise, when soliciting donations, Users themselves act as donation recipients vis-\u00e0-vis donors; KUPF Services GmbH provides no warranty to donors. <\/p>\n\n Users grant KUPF Services GmbH the non-exclusive, royalty-free right to store, reproduce and make publicly available the uploaded content to the extent necessary for the operation and promotion of the platforms. <\/p>\n\n 3. User Content and Third-Party Rights<\/strong><\/p>\n\n Users upload all content of their shop (in particular images, graphics, texts, logos as well as audio and video material) themselves. They warrant that they hold all rights required for publication on the platforms \u2013 in particular copyrights and related rights, trademark and other identifier rights as well as personality rights of persons depicted (right to one’s own image) \u2013 and that the content does not infringe any third-party rights. <\/p>\n\n Users grant KUPF Services GmbH the non-exclusive, royalty-free right to store, reproduce and make publicly available the uploaded content to the extent necessary for the operation and promotion of the platforms.<\/p>\n\n KUPF Services GmbH, as a technical service provider, merely provides the infrastructure and is not obliged to review content uploaded by Users for legal infringements. Upon indications of a possible infringement, KUPF Services GmbH is entitled to temporarily block or remove the content concerned. <\/p>\n\n If third parties assert claims against KUPF Services GmbH based on a legal infringement caused by User content (in particular infringement of copyrights, trademark rights or personality rights), Users shall fully indemnify and hold harmless KUPF Services GmbH. This also includes the reasonable costs of legal defence. Users shall support KUPF Services GmbH to the best of their ability in defending against such claims and shall provide it with all information required for this purpose. <\/p>\n\n 4. Payment Processing<\/strong><\/p>\n\n Payment processing on the platform kupfticket.com is handled by Stripe Payments Europe, Ltd., domiciled in Ireland (“Stripe”). Registration with Stripe takes place via the platform; for this purpose, the required registration information is transmitted to Stripe. The contractual and data-protection terms of Stripe apply in addition. <\/p>\n\n 5. Service Fee<\/strong><\/p>\n\n KUPF Services GmbH receives a service fee from Users for the development, maintenance, technical operation and promotion of the platforms as well as for the costs of payment processing. This fee is automatically withheld upon payment by end customers; the remaining amount is transferred to the Users’ account. <\/p>\n\n The amount of the service fee depends on the type of service processed (fee category). Separate conditions apply to transactions processed via the gastro function; these apply exclusively to the sale of food, beverages and other catering services. <\/p>\n\n For the allocation of a transaction to a fee category, the economic substance of the service is decisive, not its designation. For the purposes of these GTC, an admission ticket is any authorisation, however designated, that enables or is a prerequisite for admission to an event. Users are obliged to allocate all transactions to the applicable fee category. <\/p>\n\n In the event of incorrect allocation, KUPF Services GmbH is entitled to subsequently charge the difference to the service fee actually owed and to invoice a reasonable handling fee. KUPF Services GmbH is entitled to review the allocation of transactions for plausibility on the basis of the billing and sales data; Users shall provide the information required for this purpose upon request. In the event of repeated or serious violations, KUPF Services GmbH may block individual functions for the Users concerned; the right of termination under Section 11 remains unaffected. <\/p>\n\n The current price conditions apply, available at https:\/\/kupfservices.com\/pricing\/.<\/p>\n\n Price changes will be announced to Users at least 15 days before they take effect, in the user interface and by email to the registered email address. Users who do not agree to a price increase may terminate the contractual relationship with immediate effect at any time before the change takes effect (special right of termination). The previous conditions apply to sales and donations processed up to that point. <\/p>\n\n 6. Refunds<\/strong><\/p>\n\n If admission tickets or donations are refunded to buyers or donors \u2013 whether via the payment service provider or in cash \u2013 Users are not entitled to a refund of the service fee already paid.<\/p>\n\n 7. Donation-Deduction Status and Data Transmission to the Tax Authorities7. Spendenbeg\u00fcnstigung und Daten\u00fcbermittlung an das Finanzamt<\/strong><\/p>\n\n Users that are recognised as donation-beneficiary institutions within the meaning of Section 4a of the Austrian Income Tax Act (EStG) and activate the option in their shop indicating that donations are tax-deductible remain solely responsible for ensuring that<\/p>\n\n a) the requirements for the donation-beneficiary status remain fulfilled,<\/p>\n\n b) the special-expenses data transmission pursuant to Section 18(8) EStG to the tax authorities is carried out completely and on time, and <\/p>\n\n c) the associated statutory reporting and documentation obligations are complied with.<\/p>\n\n KUPF Services GmbH may \u2013 depending on technical possibilities \u2013 support Users with the transmission, for example through an automated transmission of the donation data via FinanzOnline on behalf of Users. This requires that Users grant the authorisations necessary for this purpose and that the transmitted data (in particular the donors’ identification data) are correct and complete. Responsibility for the correctness, completeness and timeliness of the transmission remains with the Users. <\/p>\n\n If the donation-beneficiary status ceases, the option must be deactivated without delay and KUPF Services GmbH must be informed immediately.<\/p>\n\n KUPF Services GmbH is not itself a donation recipient and assumes no liability towards Users or donors in connection with the reporting of donations to the tax authorities or with the statutory reporting and documentation obligations incumbent on Users. Furthermore, it assumes no liability for the correctness of Users’ statements that the statutory requirements for the donation-beneficiary status are fulfilled. Users shall fully indemnify and hold harmless KUPF Services GmbH with respect to the provisions of this Section 7. <\/p>\n\n 8. Changes to these GTC<\/strong><\/p>\n\n KUPF Services GmbH is entitled to amend these GTC. Planned changes will be communicated to Users at least 15 days before they take effect; the notification is made in the user interface of the platforms and by email to the registered email address. If the changes require technical or commercial adaptations on the part of Users, a reasonably longer period applies. <\/p>\n\n Consent to the amended GTC is given by active confirmation in the user interface. With this confirmation, Users also waive any notice period still running; the amended version applies to them from the time of confirmation. <\/p>\n\n The notice period does not apply where KUPF Services GmbH is obliged to make a change due to legal or regulatory requirements, or where the change is necessary to avert an unforeseen and imminent danger (in particular the security of the platforms, prevention of fraud or abuse, data protection).<\/p>\n\n Users who do not consent to the amended GTC may terminate the contractual relationship with immediate effect at any time before the changes take effect. KUPF Services GmbH may make continued use of the platforms from the effective date conditional on consent to the amended version; sales already concluded and payment obligations already incurred remain unaffected. <\/p>\n\n 9. Dispute Resolution<\/strong><\/p>\n\n Both contracting parties endeavour to resolve any problems amicably and in their mutual interest. Before a judicial resolution is sought, the contracting parties undertake to seek a solution by way of mediation. <\/p>\n\n 10. Removal of Content<\/strong><\/p>\n\n KUPF Services GmbH reserves the right to unilaterally remove from the platforms events and shops that grossly violate the socio-political principles of KUPF Services GmbH \u2013 for example events with xenophobic, racist or otherwise inhuman content \u2013 where damage to the public reputation of KUPF Services GmbH or its shareholders is to be feared.<\/p>\n\n 11. Term and Termination<\/strong><\/p>\n\n Users may cease using the platforms at any time. KUPF Services GmbH may terminate the contractual relationship with three months’ notice; in the event of serious violations of these GTC, termination may also be declared with immediate effect. Payment obligations already incurred remain unaffected. <\/p>\n\n 12. Final Provisions<\/strong><\/p>\n\n Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). For disputes arising out of or in connection with this contractual relationship, the jurisdiction of the court with subject-matter jurisdiction in Linz, Austria, is agreed to the extent legally permissible. <\/p>\n\n Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
